Definition: Law. article L. 122-5, al. 3 ° -a), of the Intellectual Property Code (CPI) has an exception to the patrimonial right of the author corresponding to the right of quotation: “when the work has been disclosed, the author cannot prohibit (... ) analyzes and short quotations justified by the critical, controversial, educational, scientific or informational nature of the work in which they are incorporated ”. Traditionally conceived for literary works, the notion of quotation seems much more delicate to apply to artistic, photographic, musical or audiovisual works. Given the requirement of brevity imposed by law and the interpretation given to it by case law, the reproduction of an artistic or photographic work in a book or its representation in the context of a program cannot be considered as "short quotes" beyond the monopoly of the author. The solution remains very uncertain as regards the broadcasting of an extract of a musical or audiovisual work in a radio or television program.
